Car Accident Liability?

Q) Last weekend me and my sister in law was involved in an accident and I do not know who is too blame. She immediatly pointed the finger at me, and I would like some advice please! Here's the story: She dropped me back to my car which was parked on a private narrow road where I lived (we were in the process of moving house). I got out the passenger side of her car and walked in front of her car and over to mine. I immediately opened my car door, to search for my new house keys in the footwell. When I was walking to my car, she was reversing into an empty driveway to turn around. Whilst I was searching for the keys my car door bumped open a bit more, little did I know she was at that point she was zooming past my car and my door banged into the side of her car causing damage to her car, and slight damage to the inside of my car door. I am of the view that she should have taken care whilst driving past, as my car door was already open and the road was narrow. can any1 help?

A) Her car was moving, your car was stationary. She hit a parked car. Her fault.

Car Alarms?

Q) my car has been vandalised a few times, once someone smashed my windscreen, and once had someone who put in tarmac in both of the door's keyholes. Now im planning on buying a car alarm, so nobody dares touching my car! i went on to ebay to see the car alarms on their and now im totally confused on what they do, because i have never bought a car alarm before. Can anyone name me a few car alarms that may be of good use for what i need the alarm for and where can i buy it? (alarm can be anything up to the price of £60) Basically i need one that should go off as soon as someone touches the car. Can you please let me know if i'd be able to fit it on my own or if i would need a pro to fit it and if so approximately how much it would cost to get it fitted? Also i saw a few alarms which have central locking or immoboliser, will they work on cars that dont have central locking or immoboliser? (because mine does'nt!) please dont start giving me suggestions like put it in a garage, obviously i dont have access to one, otherwise would!

Car Plate Numbers are supposed to be unique right?

Q) A couple of days ago I got a letter from the Police saying I had a speeding fine and would get some points on my licence .The car registration number is mine. However, today I had to go into town and was also going to post of the documents for the speeding fine (like the license number and the declarationit was me driving) and I parked in a multi-storey car park. For some reason I forgot where my car was parked and was looking around for it on loads of different levels. I was looking for my number plate as a lot of cars have a similiar design and colour to mine. I discovered the same make car as mine with my car plate number on it.!The only difference is the colour of the car. The make and car plate number is the same...even the same dealership. I even checked there and then ...as I had not posted the letter off to the police yet. Is this possible? I am pretty certain in reference to the speeding fine ...it is me..but how can someone else be driving around with my car plate number? Bloody Hell...is that right. All I did was leave a polite note on there window screen to contact me? How can the police trace trace the car it has my car plate number on it! The only thing i can think of is that the car park was secure so I am hoping they might get a picture? Should I go to the dealership too..or let the police sort it? I have noticed a lot of instances recently of police slowing down almost as if they are following me on the motorway...hense my question before. I have a criminal record but it has nothing to do at all with cars, just concerned they wouldn't stop me and start asking about my past. Bloody Hell...is that right. A) I would contact the DMV (or MVD or whatever your state calls it). It may have been a simple paperwork mix up and a duplicate set of plates got issued to a similar car. I would also contact the court that has jurisdiction after you get info from the MVD and see what your options are. You might get the ticket dismissed. What state is this in?

Car accident not entirely my fault. Do I have to pay to fix the other persons car?

Q) In mid Nov 2006. I was reversing out of a car park and there was another car waiting to use the space. I looked back before reversing and there was no car behind me. I started reversing and heard a little bump sound so I immediately stop. I saw my car has hit the other person car nearest to the drivers door causing a little dent. It wasn't the owner of the other car that was driving but the owner was present. This car just came to park right behind me so they could use my space. They did not blow their horn or anything and just watched my car hit theirs. Now they said is my fault I have to either claim it from my insurance or we settle it outside insurance. I have not heard from them since Nov 06 and suddenly I have been receiving phone calls from them. I'm not sure what my options are cos I don't want to claim from my insurance and I don't think I'm entirely guilty either. Any legal advice on what I should do?

A) Hi Flexy, This is an interesting one. Lets deal with the phone calls first. If they persistently phone you then it is harrassment and can be reported to the police. This is the Protection from Harrassment Act. Ok, now the accident. Normally, it is the fault of the person who hit the other vehicle because it is regarded as driving without due care and attention. On the other hand, there is a thing called contributory negligence. In this case the other driver saw you coming but failed to make you aware of their presence, which is what a horn is for. This could reduce your liability. I would also like to know if the driver was insured to drive the vehicle or even had a licence. Go and talk to a solicitor. Good luck.

A) You should report this to the police as soon as possible, I don't suppose you took a photo of it or got an independant witness ? It could be that your car is the ringer.

Car Insurance in the UK?

Q) I am not a UK Resident , I am here in the UK from Australia for 5 months on Holidays . This is my forth trip here and after the first time when I hired a car for 7 weeks at a cost of 1400.00 pounds i found out that it would be much better to buy a car as I was going to be here for 5 months. A few days ago i took my rent-a-car back the i had for 7 days and cost me 150.00 pounds , I found a car to buy at a cost of 1200.00 pounds but first went looking to find someone to Insure the car . I spent overs 2 hrs on the phone and there was on one that would do it for me apart from one . I have 3rd party insurance only for this car and at a cost of 1230.00 pounds for 12 months . I am at a loss as to WHY i have to pay this amount and WHY no one will do it . MY Question is why is it that there no question asked when i hire a car for as lond as i like and am covered be insurance BUT if I try to buy a car and have it Insured that is a joke , Am I a diferent driver if it is my one car ? Thanks everyone for the replay on my Insuirace problem . I just had to pay the 1230 pounds for the insurance . I did try the all you guys sent in message , I have very good friends here and they asked to have the car in there name and puit me on as a sec- driver but he could not do it because i do not live in the UK .I went through 40 Insurance Co. and there was only one that would do it , I was even told that i could not get it because we drive on the other side of the road ,,this is when i got piss off , we drive on the same side as here , just go's to show how much some people know and they work in big insurance Co. Anyhow it just looks like anyone that does not live here has to pay big time or just drive it without Insurance , the fine would be a hell of a lot less the what it just cost me . All up it cost me 1460 pounds , i may get about 500 back when i go home in 5 months , the car cost me 1000 pounds , makes no sence to me . Love coming here and just have to put up with it .

A) Im so sorry you have had this problem in the U.K. exactly the same thing happened to my cousin when he came to visit from Australia,i was willing to lend him my car for the time he was here but couldnt put him on my insurance,he ended up hiring a car for a few weeks (who insured him no problem) but it cost him a bomb,its ridiculous ,and as he says ,we do drive on the same side of the road,so no problem there.Also ,most cars in Oz are automatics ,so he had another problem finding an automatic to hire. So come on you insurance brokers,look at your policies and look after our visitors ,there are a lot of them coming here to visit theyre homeland and be fair to them !!!!

first car (family car)?

Q) we are a fmily of five (well soon will be) i am taking my driving test soon we have looked into a few cars now here is my dilema a peugeot 206 , 5 door small car, probably an ideal first car but with 3 kids is it big enough? or a citroen xsara picasso, a big family car, plenty of room but is it practical for a first car i have been learning to drive in a small ish car the new corsa so would i be better with the smaller car or the larger car??

A) you may think because your learning in a small car that's all you can drive because of its size the Picasso is a great family car and after a couple of weeks of driving it you'll think you've being driving it all your life go for it and good luck with your test

Which Car/s do you find the most desirable?

Q) Browsing through a car mag earlier and I was just thinking... some cars I find beautiful and some hideous, and I'm sure that some people find this totally opposite to my opinion... so lets hear your shout... For starters here's mine... AC Cobra - Despite being the car to start the 1st speed limit, beautiful design with a spitfire engine. Dodge Viper - Huge baulking Yank car... but every now and then the Americans do make great cars... great speed, great design. De Lorean - I see the raised eyebrows at this one... I have always found the De Lorean to be a fantastic looking car (despite the lack luster Ford V5 that went into most of them) to me, the car design just totally defines 80's design with what can sometimes (and some do) call a vision of the car of the future. Stark line, squared and the gull wing doors are (although totally inpractical) a totally iconic thing to the car. Many apologies for the incorrect info on the V5, I am certain that the cobra had a spitfire engine in it though. I drive a Jag, so eat my dust, lol

if brand new car( 2 days old and not my fault) is rear ended do i have to accept repair to car or not?

Q) I was in a stationary queue waiting for car in front to turn right when a car hit me from behind, the car was travelling at 50mph according to driver ( " I was only doing 50" ). My car a fiesta ST had the boot completely totalled, even the spare wheel was ripped out leaving a large hole in the boot floor, and the other car an astra had the front end stoved in. The driver of the astra has admitted liability and her insurance company have said that they will pay out. however i was covered by Fords 1 week free insurance, they have said that they want to repair the car,even though i have told them that i will not drive the car again, as i will not feel right in the car after it has been involved in a major accident, plus i will have to declare the accident when it comes to selling it. Do I have to have the car repaired or am I entitled to a new car as none of this is my fault?

A) if the car is repairable then your probably going to have to accept it, why would they write off a car that can be fixed safely? but if the other drivers insurance wants to pay out then it might be better doing it that way. i doubt that ford can force you to take their offer if somebody else is prepared to pay out. wouldn't this also mean you have to inform future insurance companies that you made a claim within the past 5 years or whatever it is, increasing your cost to insure?

I sold/exchanged my car privately now buyer wants to take legal action?

Q) Buyer contacted me via ad for my car & put forward his car as a possible exchange +£. He viewed my car, didn't drive it I drove the car with buyer in the passenger seat for around 3miles. We then sat in his car (he drove) the same distance/route and I looked at his car. He advised the condition of his car and I advised the condition of mine (mentioning the 3 bits that needed attention that I was aware of). I also advised buyer he is more then welcome to do any inspection/checks as I had no service history for my car. We both agreed a price and he gave me £100 deposit and I wrote out a receipt. 3 days later buyer came in his car, we completed the V5. On his request I wrote him out a reciept; his car + £amount for my car, writing registrations of both cars on receipt & 'sold as seen'. I didn't get a reciept of him. Buyer has since had an inspection and few more issues have come about that I was not aware of. He now wants to take legal action - where do I stand?

A) In the clear "caveat emptor" is the phrase here it means "buyer beware" He had full opportunity to inspect your vehicle and did so. I am sure that if he had wanted in independent inspection you would have allowed that, but he didn't. He accepted it "sold as seen". If he is not happy let him attempt legal action (do not suggest that to him though because he may construe it as a threat) If he wants to waste money going to a solicitor to be told he is in the wrong that would be up to him. .

Car accident, what can I do?

Q) I got into a car accident and here is the scenerio: Car A and Car B are traveling same direction (side by side) on a two lane road. 100 feet ahead Car A's lane is blocked because of a previous accident and it is trying to merge onto Car B's lane. At this time both are going about about 5 mph and car B is slowing down so another car in front of car A can merge onto his lane. While doing so, car A is continueing to sneak into car B's lane even though car A sees that car B is slowing down. The drive of car B sees the front bumber of Car A from the corner of his eye, and it is extreamly close to his door. A second later the two cars hit. The front passanger side pumper of Car A (trying to merge) makes contact(or clips) the driver side rear of Car B. My question is who is at fault? and more importantly, the driver of car A later told the insurance company that i was driving too fast, tryed to merge onto her lane, and her front pasinger side bumper hit. What can I do? Yeah what i figured the insurance company wouldnt know who to believe... here is a follow up question... what should have I dont at the accident scene to prevent this. (by the way, there would have been NO way i would be able to get a witness.. it was a two lane road so we had blocked it after the accident and people started honking at us, and once i moved to the right, they slammed on the gas.. So no witnesses would be available... what could have I done...

A) I had a similar situation. Car A (me) was turning left onto a freeway on ramp. Car B (other guy) was turning right onto the same ramp. The ramp is 2 lanes, I turned into the lane closest to me and he turned into the lane closest to him. About 1/2 way down the ramp, he starts coming over into my lane, without looking. I see what's happening, and move as far to the left shoulder as possible, without going into the gravel. He's still coming over, so I slammed on my brakes, hoping I'd stop before he came all the way over. It didn't work, and his left rear hit my right front fender. No witnesses in either vehicle, just the drivers. No ticket issued. He claimed I tried to merge with his lane, even though I had left skid marks on the left shoulder. It was my word against his. My insurance paid for my car, and his paid for his.

Big HUGE Problem! car wont start! bad transmission?

Q) Big HUGE Problem! Help Me Please! -------------------------------------------------------------------------------- i own an automatic 1992 325i i imported from japan. guys, i spent $3000 since last summer chasing this huge problem. i cant go anywhere with my car if i dont plan on staying 3-4 hours at that location. why? because when the engine warms up and i turn it off...i can immediately restart it. if i let the car sit for like 30 mins to an hour or so (enough that the engine cool down some)...i cant start my car for the life of me until 3-4 hours later. whats going on? this is a problem no mechanic has been able to fix even those who work and own a shop working on bmws . to make matters worse...no check engine lights or codes. i think after months of guessing that this might have to do with the transmission, i noticed while driving on step, i dont seem to have 4th gear. this is one of my many problems but this is the first problem i want to fix...i'd like to be able to start my car when ever i please damnit lol. besides its very embarrassing when a girl asks you for a ride and you have to tell her to wait 3-4 hours for the engine to finish cooling down heres some symptoms....hope this helps: 1) used to be able to burn out while the engine was warm... now can only burn out when the engine is cold or just finish warming up. 2) noticed that i loose a handsome amount of power when the car is warmed up. after the car have been driven for a while pulling out on 1st gear seems like i left on 3rd (flooring the pedal after a red light 3) when driving on automatic, when i press the gas and let go then floor the pedal....it continues from where it left off. before when i do this, the car would go into beast mode for lack of a better word 4) um...o, when i start the car when the engine is cold, on park position and neutral position, the cars revs up and down up and down up and down for like 30 good seconds before it idle normally. when i start the car when the car is cold and throw the car into position one or drive, the idle dont go up and down and up and down like when on park and neutral. 5)smell of gas when i start the car. and when i start the car after about 3 hours after it had been driven, it acts like it didnt want to start. i get bubbling noises and wierd idle and bad gas smell 6) o after driving for a while and park and throw my car into P i hear like a air or pressure lost noise. 7) change fuel pump, o2 sensor among other sensors including MAF, changed fuel filter. cant remember other things i changed right now. my aol screen name is bknycloc. my msn messenger names is bknycloc@aol.com please speak english, i cant really talk car lol. first car owner. helppppppppppp!!!!

A) Sounds like a sensor or two is bad. IF the BMW dealership can't fix this, then find another BMW dealership. I have seen computers go bad with no codes to go off of. Hmmmm.

my car was towed in orange,Ca and i took my car back! 5 months past and they took my car again, charging 3x $$

Q) this is the 15th time there have took one of my family members cars. Every time they tow one of our cars it is 300 dollars to get it out of the tow yard. Last time they took my car, i went to the tow yard to retrieved my car and i left my wallet inside of my car. I asked to get my wallet out the car so i can get my money and they opened the gate for me (which i believe would not be tresspassing) and i took my car back. On sunday, i was at my mothers house again, i filled out the form completley and correct in order for me to park there, and they towed my car. The reason why the security of the complex had my car towed, was because they said it was on a hot list. Now the tow company has my car and is trying to charge me $1010.00 dollars in order to get my car back. They are saying the reason why they are charging me so much is for towing charges 300 this time also the 300 last time, also 250 dollars for the previous time for having to wait for the police to get there for filing a report

Car hitting a car from behind?

Q) A car ran into a car and hit the back of it, the car that was hit then ran into a car in front of him. Does the car in the middle that was pushed into the front car have to pay for the front car or does the car that hit the middle car have to pay for the front car. I have heard it both ways, because the driver was to close and did not have his car under control at all times. This did happen at a stop light.

A) The driver that caused the accident is the one who has to pay for all the damage. The driver in the middle was stopped. He was hit. As long as he was stopped without touching the car in front of him (prior to being hit and pushed forward), he did nothing wrong. No matter how many cars are in the chain reaction, the driver who hits the rear and caused the accident is the one liable. This assumes that this is not a no fault state, where you are not held accountable for the damage you cause!

Car purchase?

Q) I purchased a car 13 days ago however the dealer called me and stated the finance company would not finance the car. All of the paper work was done contract signed they took my old car, closed the deal and i have been driving the car for 13 days. They are now requesting proof of income, 5 personal references, and proof of address. I asked them for my car back and they said they no longer have the car i traded in and sold it wholesale. How could they close the deal get rid of my car, allow me to have the new car if they did not verify all of this information before hand? They do not want me to return the car. This is my 5th car i know it does not take 12 or 13 days to verify information. They also explained that another bank is willing to finance the car. So all of the paperwork and contract needs to be redone. What rights do i have and can i be compensated for their mistake? [ Please note i paid $1000.00 down payment.

A) This is a common "spot delivery" scam. Some states have passed or are considering legislation to stop it. In the mean-time, see a lawyer about your possible options & remedies.

My car starts up but starts up with things not working on car. AC,Windows,wipers, ect...any idea what it is?

Q) I recently purchased a car from some small autoshop. The car runs fine except for one little problem that has been happening. It does not happen every time i start up the car but every once in a while, maybe one time a day, some things in the car will not work. I'll start the car up and the AC, power windows, speedomiter, and wipers will not be on. If i let the car sit there running for a minute or two they will come on by themselves. If i turn the car off and try to restart the car they will come on right away. I don't have a problem with them not working once they start working but it does seem to only happen when the car is started occasionally. The car started having this problem when i first got it and it stopped happening until recently. After i got my fuel injectors cleaned then it started back up again. I was told it may be my speed sensor but i am not sure. Does anyone have any suggestions on what it may be? The car is a 97 Tiburon

A) sounds like an ignition switch problem... next time it happens try moving the key slightly and see if the wipers etc will come back on

Do you like the car park?

But he was here, with his can of coke and his Lion Bar, waiting for it all to happen. He felt a chill in his stomach that had nothing to do with the cold outside. He twirled the knob of the radio. It was all dance music and ragga from local pirate stations. Then he hit the news. They were talking about the death of some statesman. But what did any of it have to do with him? The first time had been in a car park in Brixton; he had enjoyed it, but it had taken him nearly two hours to drive home afterwards. So he searched the internet for a location closer to him; somewhere in north London. And he had stumbled upon the car park, just five minutes away from his flat.
